How to get a medical marijuana card in California starting 2018?

Starting in 2018 in California, you’ll have marijuana products that are designated for recreational use. Then there are marijuana products designated for medical use.

The recreational use products are available to those over the age of 21 without needing a medical marijuana card.

The medical use marijuana products are available to those with a medical marijuana card. And, just like it’s been since 1996 in California, you do have to see a doctor to get evaluated for a medical marijuana card. So, the benefit of having a medical marijuana card is that you have access to marijuana products designated for medical use in addition to the marijuana products designated for recreational use.

Now, to save taxes on the marijuana products, you have to apply for a Medical Marijuana Identification (ID) Card through the California Dept. of Public Health.

First of all, a patient has to have a serious medical condition to qualify for a Medical Marijuana Identification (ID) Card. And, a serious medical condition on the California Dept of Health’s website is defined as the following,

“…AIDS; anorexia; arthritis; cachexia (wasting syndrome); cancer; chronic pain; glaucoma; migraine; persistent muscle spasms (e.g., spasms associated with multiple sclerosis); seizures (e.g., epileptic seizures); severe nausea; any other chronic or persistent medical symptom that either substantially limits a person’s ability to conduct one or more of major life activities as defined in the Americans with Disabilities Act of 1990, or if not alleviated, may cause serious harm to the person’s safety, physical, or mental health.”

With the Medical Marijuana Identification (ID) card, patients do not have to pay the sales and use tax when making retail purchases of medical cannabis, medical cannabis concentrate, edible medical cannabis products or topical cannabis.

So for example, starting 2018, in Oakland, the taxes will increase from 14.25% to 34.25% and in San Jose taxes will increase from 19.25% to 34.25%. In Berkeley, there’s going to be a mandatory State Excise Tax of 15%, a Sales Tax of 9.25% and a Transfer Tax of 2.5%.

There is a cost to obtain the Medical Marijuana Identification Card. The maximum fee is limited to $100 per card. For Medi-Cal patients, the fee is limited to $50 per card. And for indigent patients, it’s free.
